Please read these Terms & Conditions ("Terms") carefully before using the website activeheating-cooling.com (the "Site") or engaging the services of Active Heating & Cooling LLC ("we," "us," or "our"). By accessing our Site, using our online estimate tool, booking an appointment, or hiring us for HVAC services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Site or services.

1. Services

Active Heating & Cooling LLC provides residential and commercial HVAC services in Auburn, WA and the surrounding South King County area, including but not limited to:

• Furnace replacement and installation (80% efficiency, 96% high-efficiency, and electric/air handler)

• Central air conditioning installation

• Heat pump installation

• Ductless mini-split installation

• Full HVAC system replacement

• 24/7 emergency HVAC service

• HVAC maintenance and tune-ups

Our service area includes Auburn, Kent, Renton, Covington, Black Diamond, Federal Way, and Maple Valley, Washington. Service availability outside of these areas is at our discretion.

2. Online Estimates

Our website includes an online install estimate tool that provides approximate price ranges for HVAC installations based on information you provide (system type, home size, and preferences). These estimates are for informational purposes only and do not constitute a binding quote, contract, or guarantee of final pricing.

Final pricing is determined after an in-home assessment by one of our technicians and may vary based on factors including but not limited to:

• Actual home conditions and existing ductwork

• Permit requirements and local code compliance

• Equipment availability and manufacturer pricing changes

• Additional materials, labor, or modifications required

• Current rebate and tax credit availability

3. Appointments and Scheduling

3.1 Booking

Appointments can be booked through our website, by phone at (206) 900-4662, or by email at activeheatingcooling@gmail.com. Booking an appointment does not constitute a binding contract for services until a written proposal or work order is agreed upon by both parties.

3.2 Cancellations and Rescheduling

We understand that schedules change. We ask that you provide at least 24 hours' notice if you need to cancel or reschedule an appointment. Repeated no-shows or last-minute cancellations may result in a scheduling fee for future appointments.

3.3 Access to Property

By scheduling a service appointment, you confirm that you are the property owner or have authorization from the property owner to allow HVAC work to be performed. You agree to provide safe, reasonable access to the work area, including the indoor unit, outdoor unit, electrical panel, and thermostat locations.

4. Pricing, Payment, and Financing

4.1 Pricing

All pricing is provided in U.S. dollars. Prices quoted in a written proposal are valid for 30 days from the date of the proposal unless otherwise stated. We reserve the right to adjust pricing if the scope of work changes after the proposal is accepted or if unforeseen conditions are discovered during installation.

4.2 Payment

We accept the following forms of payment: cash, check, credit card (Visa, Mastercard, American Express, Discover), and approved financing. Payment terms are outlined in your service agreement or invoice. For installations, a deposit may be required at the time of scheduling, with the balance due upon completion of work.

4.3 Financing

Financing options are provided through third-party financing partners and are subject to credit approval and the terms and conditions of the financing provider. Active Heating & Cooling LLC is not a lender and does not determine financing eligibility, interest rates, or repayment terms.

4.4 Late Payment

Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month (18% annually) on the outstanding balance, or the maximum rate permitted by Washington State law, whichever is less.

5. Warranties

5.1 Manufacturer Warranties

All equipment we install comes with the manufacturer's standard warranty. Warranty terms, duration, and coverage vary by manufacturer and product. We will assist you with warranty registration at the time of installation and can help you navigate the warranty claim process if issues arise.

5.2 Workmanship Warranty

We stand behind our work. Active Heating & Cooling LLC provides a workmanship warranty on all installations performed by our technicians. Details and duration of our workmanship warranty are provided in your service agreement. This warranty covers defects in our installation labor and does not cover equipment malfunctions, normal wear and tear, or damage caused by misuse, lack of maintenance, or acts of nature.

5.3 Warranty Limitations

Warranties may be voided if:

• Equipment is modified, tampered with, or serviced by unauthorized personnel

• Required maintenance (such as regular filter changes) is not performed

• The system is used outside of its intended design specifications

• Damage is caused by power surges, flooding, fire, or other events beyond our control

6. Permits and Inspections

HVAC installations in Washington State may require permits and inspections by local building authorities. Active Heating & Cooling LLC will obtain all necessary permits for work we perform and will coordinate required inspections. Permit fees are included in your quoted price unless otherwise noted. You agree to cooperate with any required inspections, including providing access to the property for inspectors.

7. Rebates and Tax Credits

We may provide information about available utility rebates (such as PSE rebates) and federal tax credits (such as IRA energy efficiency credits) to help you save on qualifying installations. However:

• Rebate and tax credit availability, amounts, and eligibility requirements are determined by the issuing authority (utility company, federal government, etc.) and are subject to change without notice

• We do not guarantee that you will qualify for any specific rebate or tax credit

• Information about rebates and tax credits provided on our website or by our staff is for general informational purposes only and does not constitute tax or financial advice

• We recommend consulting with a qualified tax professional regarding your eligibility for any tax credits

8. Limitation of Liability

To the fullest extent permitted by Washington State law:

• Active Heating & Cooling LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services, website, or these Terms

• Our total liability for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim

• We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to severe weather, equipment shortages, supply chain disruptions, utility outages, or government actions

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

9. Use of Our Website

9.1 Acceptable Use

You agree to use our website only for lawful purposes and in a manner that does not infringe on the rights of others or restrict or inhibit their use and enjoyment of the Site. You may not:

• Use the Site for any fraudulent or unlawful purpose

• Submit false information through our forms or estimate tools

• Attempt to gain unauthorized access to our systems or data

• Reproduce, distribute, or modify any content from our Site without our written consent

• Use automated tools (bots, scrapers) to collect information from our Site

9.2 Intellectual Property

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website with a revised "Effective Date." Your continued use of our Site or services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreements or proposals, constitute the entire agreement between you and Active Heating & Cooling LLC regarding your use of our website and services. Any prior agreements or understandings, whether written or oral, are superseded by these Terms.
